US appeals court rules many Trump tariffs illegal and void

A US appeals court has declared many of US President Donald Trump’s sweeping tariffs illegal and void, upholding a lower court ruling.

The US Court of Appeals for the Federal Circuit issued the decision on Friday.

In May, the US Court of International Trade ordered an injunction on the tariffs that were based on the International Emergency Economic Powers Act, or IEEPA.

It said the levies exceed any authority granted by the law to the president.

The Trump administration appealed the ruling.

The appeals court supported the decision by the trade court by saying, the IEEPA “bestows significant authority on the President to undertake a number of actions in response to a declared national emergency, but none of these actions explicitly include the power to impose tariffs, duties or the like, or the power to tax.”

Trump indicated he will appeal the ruling. He wrote in a social media post, “Today a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed.”

The tariff measures will be in effect until the US Supreme Court decides on the matter.

The court order covers what Trump calls “reciprocal tariffs” on countries and regions that have large trade surpluses with the US.

It also applies to a 10-percent universal duty, and additional tariffs Trump imposed on China, Mexico and Canada, saying they were not doing enough to stop the influx of fentanyl and other drugs to the US.

But tariffs on automobiles and steel products, which were imposed based on another law, are not included.
